{"id":32569,"date":"2013-09-13T14:09:15","date_gmt":"2013-09-13T18:09:15","guid":{"rendered":"http:\/\/www.shilohwalker.com\/website\/?p=32569"},"modified":"2013-09-13T14:09:15","modified_gmt":"2013-09-13T18:09:15","slug":"heartbreaking","status":"publish","type":"post","link":"https:\/\/www.shilohwalker.com\/website\/2013\/09\/heartbreaking\/","title":{"rendered":"Heartbreaking"},"content":{"rendered":"<p>South Dakota seems to be in flagrant violation of the <em><strong><a href=\"http:\/\/www.nicwa.org\/Indian_Child_Welfare_Act\/\" target=\"_blank\">Indian Child Welfare Act<\/a><\/strong><\/em>, a law designed to keep American Indian kids with American Indian families. \u00a0It makes sense. \u00a0The only way to keep their heritage alive is to keep these kids with the families who can pass traditions on. Not to mention&#8230;<em>a family shouldn&#8217;t be torn apart for no reason<\/em>. \u00a0Many kids are taken away for\u00a0<em>no<\/em> reason. \u00a0Some kids are abandoned, some are abused, but instead of seeking relatives or foster care within the tribe, as federal law seems to require (from what I can tell) they shuttle these kids off to white foster facilities or white foster homes.<\/p>\n<p>Every year, hundreds of Lakota kids in South Dakota are removed from their homes and put not with Lakota families, but in white foster facilities. \u00a0Here is one story (<a href=\"http:\/\/lakotalaw.org\/lakota-child-rescue-project\/\" target=\"_blank\">source<\/a>)<\/p>\n<blockquote><p>One afternoon in 2008, Janice Howe\u2014a Dakota Indian\u2014waited at the bus stop for her grandchildren to come home from school. They never arrived.<\/p>\n<p>Earlier that day, a social worker had taken Janice&#8217;s grandchildren. They were driven to a white foster facility hundreds of miles away. The reason stated in the case file: a &#8220;rumor&#8221; that Janice&#8217;s daughter, Erin Yellow Robe, had been using drugs. She hadn&#8217;t. <strong>To this day, Janice&#8217;s daughter hasn&#8217;t been charged or arrested for drugs\u2014or anything else.<\/strong><\/p>\n<p>For the next year and a half, Janice fought to get her grandchildren back. She called the state&#8217;s director of social services. She wrote letters to the governor. Finally, she convinced her tribal council to threaten the state with kidnapping. A few weeks later, her grandchildren were returned&#8230;on a &#8220;trial basis.&#8221;<\/p><\/blockquote>\n<p>Many kids go through <em><strong><a href=\"http:\/\/www.lakotalaw.org\/lakota-child-rescue-project\/rachel-brugiers-story\" target=\"_blank\">sexual and physical abuse<\/a><\/strong><\/em> in the foster homes. The most heartbreaking case, though, is this one. \u00a0Four children were removed from a home for &#8216;neglect&#8217;&#8230; probably because the family was poor. \u00a0Many native families\u00a0<em>are<\/em>. \u00a0And one girl, under the age of 10, was sexually assaulted, multiple times, by her foster father. \u00a0He pled guilty. \u00a0The child advocates who tried to protect her were persecuted by the state-the attorney was fired and both the child advocate and the attorney were charged with tampering with evidence, etc, etc&#8230; (source and more info <em><strong><a href=\"http:\/\/sdpeacejustice.wordpress.com\/2013\/01\/11\/justice-served-for-shirley-schwab-and-brandon-taliaferr\/\" target=\"_blank\">here.<\/a><\/strong><\/em>)<\/p>\n<p>It would seem the kids were bullied, <em><strong><a href=\"http:\/\/100r.org\/2012\/12\/rough-justice-in-indian-child-welfare\/\" target=\"_blank\">harassed<\/a><\/strong><\/em> by investigators as they tried to get the kids to change their story.<\/p>\n<blockquote><p>One by one, the children faced Agent Mark Black of the Department of Criminal Investigations and a partner. The children were each alone, without an adult present on their behalf.<\/p>\n<p>While being questioned by the agents, the children became fearful and wept, according to someone familiar with the case who asked not to be identified for fear of retribution. The youngsters were apparently not told they were being recorded. While left alone for a time, one explored the room, discovered the camera equipment behind a peephole, and began to cry.<\/p>\n<p>The DCI video of the interrogation is now a court document. In a four-minute excerpt that\u00a0<a href=\"http:\/\/www.youtube.com\/watch?v=Ev1mLcuVMe4&amp;feature=youtu.be\" target=\"_blank\">can be seen on YouTube<\/a><em>,<\/em>\u00a0the agents are taking a break. They\u2019re off-camera, apparently unaware that the microphone is still picking up their voices as they plan their strategy.<\/p>\n<p>One agent says the children \u201chave been f\u2014ing with us.\u201d The men talk about questioning the therapist to whom the children described the sexual assaults. Agent Black says, \u201cI guarantee we put [her] in here. Put the f\u2014ing hot screws in her. Bitch you\u2019re in f\u2014ing deep shit. You better start talking.\u201d Later Black says, \u201cAt least we f\u2014 with Brandon.\u201d<\/p><\/blockquote>\n<p>Why does this happen? \u00a0I don&#8217;t know&#8230; but look at this.<\/p>\n<p>&nbsp;<\/p>\n<blockquote><p>National Public Radio broadcast a\u00a0<a href=\"http:\/\/www.npr.org\/2011\/10\/25\/141672992\/native-foster-care-lost-children-shattered-families\" target=\"_blank\">scathing report<\/a>, charging South Dakota with rampant taking of American Indian children into foster care. The network said the state receives $100 million dollars annually in federal funds on behalf of foster children of all races, giving it an incentive to keep the numbers of children in care high. (<a href=\"http:\/\/100r.org\/2012\/12\/rough-justice-in-indian-child-welfare\/\" target=\"_blank\">source<\/a>)<\/p><\/blockquote>\n<p>and<\/p>\n<blockquote><p>However, in the politics of South Dakota\u2019s royally screwed-up Native foster care system, where separating Lakota children from their families for \u201cneglect\u201d (read: poverty) is a\u00a0<strong><a href=\"http:\/\/100r.org\/2012\/12\/rough-justice-in-indian-child-welfare\/\">lucrative proposition<\/a>\u00a0<\/strong><span style=\"font-size: 16px;\">for the state, bringing in thousands of dollars per child in federal aid, getting in the way can get you thrown under the bus. (<a href=\"http:\/\/sdpeacejustice.wordpress.com\/2013\/01\/11\/justice-served-for-shirley-schwab-and-brandon-taliaferr\/\" target=\"_blank\">source<\/a>)<\/span><\/p><\/blockquote>\n<p>The Lakota People&#8217;s Law Project is <strong><em><a href=\"https:\/\/www.facebook.com\/LakotaPeoplesLawProject\/app_201742856511228\" target=\"_blank\">petitioning <\/a><\/em><\/strong>Congress to investigate South Dakota&#8217;s abuse of the Indian Child Welfare Act.<\/p>\n<blockquote><p>A 1976 study by the Association on American Indian Affairs found that 25 to 35% of all Indian children were being placed in out-of-home care. Eighty-five percent of those children were being placed in non-Indian homes or institutions.
