FYI, I’m going to be reposting this.\u00a0 Often.\u00a0 Probably once a month-I’ve even set up a REMINDER..gak.\u00a0 I want those idiots who claim to have rights to my copyright aware of the fact that…well, they don’t<\/em> have rights to my copyright.\u00a0 So…\u00a0 (:\u00a0 I’m just keeping this word out there.\u00a0 BTW, this stuff also applies to writers who aren’t me<\/em>. \u00a0 For modern works, after 1978 and somebody is claiming to have ‘master resale rights’ or ”I’m the copyright owner” or any crap like that over a work…it’s very likely FALSE<\/em>.\u00a0 Copyright remains in place for the author’s lifetime, plus 70 years<\/a><\/strong>.\u00a0 Info on that<\/em> can be found at copyright.gov – a nice government-y website so don’t be fooled by the BS.<\/p><\/blockquote>\n

Okay, I\u2019m hoping some people out there researching \u2018master resell rights\u2019 stumble onto this page.\u00a0 Or I hope some of the people mistakenly claiming to be \u2018authorized ebook resellers\u2019 find this page.<\/p>\n

Because I\u2019ve got news for you.<\/p>\n

You can\u2019t buy the resale rights to my work\u2026unless you go through me, and I can\u2019t sell them to you, because it would be conflict with my contract to my publisher. Which could get me sued.\u00a0 Which is why I\u2019m pretty certain other authors out there aren\u2019t likely to be doing this either.<\/p>\n

You can resell a paperback, because after all, there is just the one copy.<\/p>\n

But you can\u2019t resell ebook after ebook after ebook because that\u2019s not selling one copy-that\u2019s making new copies and you know what that does?\u00a0 That violates my copyright.\u00a0 I own the rights to my work.<\/em> Me.\u00a0 Just me.<\/p>\n

I contract with my publisher and they publish the books.\u00a0 Through my publisher, I may sell the foreign rights (and please, dear God, I\u2019d really love to), I can sell the audio rights (please God, I would love to) and other assorted rights.\u00a0 I own the rights.\u00a0 They are mine.\u00a0 You can\u2019t buy a \u2018master resale right\u2019 to anything I\u2019ve written, because I won\u2019t give it up.<\/p>\n

If somebody claims they can give you master resale rights, you were lied to.\u00a0\u00a0 Possibly by mistake, possibly with the intention of deceiving you, I don\u2019t know.\u00a0 Email the publisher if you don\u2019t believe me-ask the person claiming the \u2018resale rights\u2019 bit who their contact at the publisher was.\u00a0 But don\u2019t shell out money to somebody who claims to give you master resale rights to ebooks.<\/p>\n

Now this isn\u2019t to say there aren\u2019t books out there with \u2018master resale rights\u2019.\u00a0 I see all this \u2019set up your own ebook biz\u2019 and all the ebooks are self-help and do-it-yourself, and maybe, just maybe, those do come with legit resale rights.<\/p>\n

But if you think Nora Roberts sold her resale rights to somebody who in turn now sells them out to others so they can sell a slew of them on ebay for a few bucks when the author doesn\u2019t see a red cent for all her hard work, you\u2019re wrong-somehow, I suspect Nora Roberts is a little too smart for that. She doesn\u2019t do it. \u00a0 Neither does Shiloh Walker, neither does Larissa Ione, neither does Lauren Dane, neither does any fricking writer I\u2019ve talked to about this\u2026and yeah, writers do talk about it.\u00a0 A lot.<\/p>\n

Publishing doesn\u2019t work that way.<\/p>\n

Ebook publishing doesn\u2019t work that way.<\/p>\n

This is about rights.\u00a0 Plain and simple rights.\u00a0 When people \u2018create\u2019 digital copies of our work, they are making new<\/em> copies-that is copyright infringement-and that violates our rights.\u00a0 Plain and simple.\u00a0 It violates our rights and if somebody came in and rode roughshod all over your legal rights, you\u2019d be\u00a0 bit upset.\u00a0 You do not have the legal<\/em> rights to resell our works, no matter what you were told.<\/p>\n

And if anybody who was told this is reading this\u2026seriously, completely seriously, I want to know who is telling you.\u00a0\u00a0\u00a0 You were misinformed.\u00a0 A lot of people have been misinformed and that circle won\u2019t stop until we get to the root of it all.<\/p>\n

Quickie update… a few people have emailed, wondering how to get their own work down at iOffer.\u00a0 It’s easy-send a DMCA.\u00a0 They have<\/em> to honor a true DMCA takedown request from the copyright owner.\u00a0 They are protected by safe harbor laws – meaning they can’t get sued – as long as they are taking action against those who are infringing on copyright owners’ rights. <\/strong><\/p>\n

You can find a sample listing *here<\/a><\/em>*.\u00a0 Save the info to a word doc and just keep using the same form as needed. One bit of advice-stick to the DMCA, be courteous, be professional, give them just<\/em> the info needed and nothing more, nothing less in the take-down.
\n<\/strong><\/p>\n

If you send a DMCA takedown, they’ll remove your works.\u00a0 Use the DMCA–follow it, to the letter.\u00a0 I use my PO box, if you don’t have one you can use a legal representative, say your publisher’s street addy.\u00a0 Also, for those on ioffer & ebay who repeatedly infringe, those safe harbor laws only<\/em> protect these sites if they take action against repeated abusers, I believe.\u00a0 When I see those repeatedly abusing my copyright, I point out repeated complaints, and those sellers often go bye-bye, their entire accouts.\u00a0 Yes, they pop back up, but keep at it.\u00a0 The more people who become vigilant and stay<\/em> vigilant, the better.\u00a0 Since these sites have<\/em> to take these listings down within a timely manner, perhaps if more<\/em> authors became proactive, these sites would become proactive as well.<\/strong><\/p>\n
